As rationing decisions become more of an immediate reality for healthcare practitioners it is important to design mechanisms that facilitate carefully deliberated outcomes. No individual can be expected to be able to cover wide debate on their own, so an exercise has been designed that helps generate consensus decisions from diverse opinions. The exercise was piloted with two groups, an undergraduate medical class and the members of a general practice. Though the aims were different for each group, the tool was (...) useful to both for producing the desired outcomes. Expert and non-expert knowledge were drawn upon and rationing prioritisation lists regarding funding of infertility treatment were generated. A description of the exercise and the results produced by the two groups are provided, as well as the theoretical placement for the significance of forming consensus from diversity. (shrink)

At least since John Locke, writers have pitted power against lawfulness, championing the rule of law for its protection of the political order against both popular and governmental overreaching. Aristotle is often cited as the source of this opposition between power and lawfulness insofar as he takes law to constrain the overreaching characteristic of human nature, the rule of law to exemplify reason’s moderation of desire, and the constitution to be the source of the rule of law. Offering an interpretation (...) of Aristotle which challenges the opposition between reason and desire driving most formulations of the rule of law, this Article argues that Aristotle understands the rule of law as itself a practice of political power, issuing from practical wisdom, which combines reason and desire. Treating the rule of law, in this way, as the rule of men as well raises the possibility that the question of political authority, at the heart of debates about constitutionalism, is at the same time a question of political authorship and accountability — accountability to, and of, both a regime and a people. This essay examines the political trials through which, according to Machiavelli's Discourses, republics should punish magistrates and prominent citizens who threaten or violate popular liberty. Unlike modern constitutions, which assign indictments and appeals to small numbers of government officials, Machiavelli's neo-Roman model encourages individual citizens to accuse corrupt or usurping elites and promotes the entire citizenry as political jury and court of appeal. Machiavellian political justice requires, on the one hand, equitable, legal procedures that serve all citizens by punishing guilty (...) parties and discouraging retaliatory reprisals, including foreign intervention. On the other hand, frankly acknowledging the power disparities that exist in every republic, Machiavelli outlines how political trials enable pro-plebeian magistrates and populist reformers to thwart patrician-generated smear campaigns and oligarchic conspiracies. This Special Issue commemorates the 60th anniversary of Business & Society with nine rigorous literature reviews that address important societal problems and provide opportunities for theory development in the business and society field; in this introduction we present an overview of the Special Issue. With the theme “Building on Its Past,” the nine articles address a host of contemporary issues, including climate change, wicked problems, business and human rights, human health, certifications standards, the governance of artificial intelligence, stakeholder engagement, stakeholder (...) theory, and corporate political activity. Together, these reviews offer a wealth of suggested themes, theories and approaches that can drive our research forward for the next decades in business and society research and practice. Using the lens of a miner-prospector continuum to categorize the diversity of articles within this special issue, a common theme emerges across the portfolio of reviews: they all call for a more systemic and integrative perspective toward studying the complex interactions that link business and society actors and issues. Building on these findings, we encourage future scholars to fill long-standing researched gaps through a more open systems approach, which supports both contextually sensitive and multi-level and multi-disciplinary approaches to address grand societal challenges. We conclude with specific suggestions as to how business and society scholars might use an open systems approach, including embracing methodologies to address complex causal pathways, theorizing with a view towards spanning external and internal elements of an organization, and reflecting on the temporal and spatial dynamics of complex systems. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Engagement happens when academics and non-academics form partnerships to create mutual understanding, and then take action together. An example is the “value web” work associated with W. K. Kellogg Foundation’s Food Systems Higher Education–Community Partnership. Partners nationally work on local food systems development by building value webs. “Value chains,” a concept with considerable currency in the private sector, involves creating non-hierarchical relationships among otherwise disparate actors and entities to achieve collective common goals. The value web concept is extended herein by (...) separating the values of the web itself, such as the value of collaboration, from values “in” the web, such as credence values associated with a product or service. By sharing and discussing case examples of work underway around the United States, the authors make a case for employing the value webs concept to represent a strategy for local food systems development, specifically, and for higher education–community partnerships, generally. According to Frank, Plato's dialogues offer divergent approaches to literacy: while one method is rigidly top-down, the other promotes learners' independence. She argues that Plato endorses the latter view and that this lens on becoming literate is also the one he favors for our acquisition of knowledge, as well as for ethics and politics. Dismissing the idea that Plato's thought developed, Frank moves without comment from the Republic to works usually deemed to belong to different phases of Plato's (...) writing, both early and late. Because Frank's approach is nondoctrinal, in no dialogue is its main character properly seen as Plato's "mouthpiece".... (shrink)

The three learning modalities in nursing education are classroom meetings, skill laboratory practices, and clinical practice in hospital or community settings. In clinical internships, the collaborative self-directed learning method is highly encouraged among nursing students. The use of information and communication technologies (ICT) in clinical learning supports the implementation of evidence-based nursing and student-centered learning. The current study examines whether the relationship between social influence and ICT using intention is moderated by the daily duration of use and the number of (...) classmates being friends on social media. The Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 702 Moroccan nursing students. We found that social influence was positively associated with nursing students’ intention to use ICT for clinical learning during the internship. This positive association was positively moderated by the daily duration of social media usage and negatively moderated by the number of classmates being friends on social media. These findings underscore the potential of using social media platforms to facilitate the incorporation of ICT and social media in nursing education and training. However, the adverse effects of social media on students’ mental well-being also need to be acknowledged and managed appropriately. (shrink)

Frank A. Lewis presents a close study of book Zeta of Aristotle's Metaphysics, one of his most dense and controversial texts, commonly understood to contain his deepest thoughts on the definition of substance and related metaphysical issues. Lewis argues that Aristotle returns to the causal view of primary substance from his Posterior Analytics.

One of the main purposes of feminist jurisprudence is to create or find better ways of being and living for women through the analysis, critique, and use of law. Rich work has emerged, and continues to emerge, from feminist theorists exploring conceptions of the self, personhood, identity and subjectivity that could be used to form a basic unit in law and politics. In this article, it is argued that a strong sense of human subjectivity needs to be retained to enable (...) the human potentiality of women and men to flourish. This can be done in a way which is not essentialist, yet does not dissolve the subject out of existence, issues pertinent to feminist jurisprudence in recent years. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

This paper begins with a brief examination of the contemporary American political landscape. I describe three recent events that illustrate how attempts to control the narrative about events that transpired threaten to undermine our shared reality. I then turn to Book I of Plato’s Republic to explore the potentially tyrannizing effect of Socrates’s narrative voice. I focus on his descriptions of Glaucon, Polemarchus and his slave, and Thrasymachus to show how Plato presents Socrates’s narrative activity as a process that controls (...) how the auditor understands the events that follow. I then turn to an alternate understanding of Socratic narrative which extols its philosophically and politically liberatory possibilities. I use my own previous work on Socratic narrative, Jill Frank’s Poetic Justice, and Rebecca’s LeMoine’s Plato’s Cave as three examples that emphasize the more positive dimensions of Socratic narrative. Finally, I end with a brief exploration of Cornel West’s Democracy Matters, and bell hooks’ works on pedagogy to argue for the possibility a Socratically-informed public space for political discourse. What is the place of language in human cognition? Do we sometimes think in natural language? Or is language for purposes of interpersonal communication only? Although these questions have been much debated in the past, they have almost dropped from sight in recent decades amongst those interested in the cognitive sciences. Language and Thought is intended to persuade such people to think again. It brings together essays by a distinguished interdisciplinary team of philosophers and psychologists, who discuss various ways in (...) which language may be implicated in human cognition. The editors have provided an introduction which lays out the basic terms and history of the debate, and a consolidated bibliography which will provide a valuable reference resource for all those interested in this area. This book is an anthology with the following themes. Non-European Tradition: Bussanich interprets main themes of Hindu ethics, including its roots in ritual sacrifice, its relationship to religious duty, society, individual human well-being, and psychic liberation. To best assess the truth of Hindu ethics, he argues for dialogue with premodern Western thought. Pfister takes up the question of human nature as a case study in Chinese ethics. Is our nature inherently good (as Mengzi argued) or bad (Xunzi’s view)? Pfister ob- (...) serves their underlying agreement, that human beings are capable of becoming good, and makes precise the disagreement: whether we achieve goodness by cultivating autonomous feelings or by accepting external precepts. There are political consequences: whether government should aim to respect and em- power individual choices or to be a controlling authority. Early Greek Thinking: Collobert examines the bases of Homeric ethics in fame, prudence, and shame, and how these guide the deliberations of heroes. She observes how, by depending upon the poet’s words, the hero gains a quasi- immortality, although in truth there is no consolation for each person’s inevi- table death. Plato: Santas examines Socratic Method and ethics in Republic 1. There Socrates examines definitions of justice and tests them by comparison to the arts and sciences. Santas shows the similarities of Socrates’ method to John Rawls’ method of considered judgments in reflective equilibrium. McPherran interprets Plato’s religious dimension as like that of his teacher Socrates. McPherran shows how Plato appropriates, reshapes, and extends the religious conventions of his own time in the service of establishing the new enterprise of philosophy. Ac- cording to Taylor, Socrates believes that humans in general have the task of helping the gods by making their own souls as good as possible, and Socrates’ unique ability to cross-examine imposes on him the special task of helping others to become as good as possible. This conception of Socrates’ mission is Plato’s own, consisting in an extension of the traditional conception of piety as helping the gods. Brickhouse and Smith propose a new understanding of Socratic moral psychology—one that retains the standard view of Socrates as an intellectualist, but also recognizes roles in human agency for appetites and passions. They compare and contrast the Socratic view to the picture of moral psychology we get in other dialogues of Plato. Hardy also proposes a new, non-reductive understanding of Socratic eudaimonism—he argues that Socrates invokes a very rich and complex notion of the “Knowledge of the Good and Bad”, which is associated with the motivating forces of the virtues. Rudebusch defends Socrates’ argument that knowledge can never be impotent in the face of psychic passions. He considers the standard objections: that knowledge cannot weigh incom- mensurable human values, and that brute desire, all by itself, is capable of moving the soul to action. Aristotle: Anagnostopoulos interprets Aristotle on the nature and acquisition of virtue. Though virtue of character, aiming at human happiness, requires a complex awareness of multiple dimensions of one’s experience, it is not properly a cognitive capacity. Thus it requires habituation, not education, according to Aristotle, in order to align the unruly elements of the soul with reason’s knowledge of what promotes happiness. Shields explains Aristotle’s doctrine that goodness is meant in many ways as the doctrine that there are different analyses of goodness for different types of circumstance, just as for being. He finds Aristotle to argue for this conclusion, against Plato’s doctrine of the unity of the Good, by applying the tests for homonymy and as an immediate cons- equence of the doctrine of categories. Shields evaluates the issue as unresolved at present. Russell discusses Aristotle’s account of practical deliberation and its virtue, intelligence (phronesis). He relates the account to contemporary philo- sophical controversies surrounding Aristotle’s view that intelligence is neces- sary for moral virtue, including the objections that in some cases it is unnecessary or even impedes human goodness. Frede examines the advantages and disadvantages of Aristotle’s virtue ethics. She explains the general Greek con- ceptions of happiness and virtue, Aristotle’s conception of phronesis and compares the Aristotle’s ethics with modern accounts. Liske discusses the question of whether the Aristotelian account of virtue entails an ethical-psy- chological determinism. He argues that Aristotle’s understanding of hexis allows for free action and ethical responsibility : By making decisions for good actions we are able to stabilize our character (hexis). Hellenistic and Roman: Annas defends an account of stoic ethics, according to which the three parts of Stoicism—logic, physics, and ethics—are integrated as the parts of an egg, not as the parts of a building. Since by this analogy no one part is a foundation for the rest, pedagogical decisions may govern the choice of numerous, equally valid, presentations of Stoic ethics. Piering interprets the Cynic way of life as a distinctive philosophy. In their ethics, Cynics value neither pleasure nor tradition but personal liberty, which they achieve by self-suffi- ciency and display in speech that is frank to the point of insult. Plotinus and Neoplatonism: Gerson outlines the place of ordinary civic virtue as well as philosophically contemplative excellence in Neoplatonism. In doing so he attempts to show how one and the same good can be both action-guiding in human life and be the absolute simple One that grounds the explanation of everything in the universe. Delcomminette follows Plotinus’s path to the Good as the foundation of free will, first in the freedom of Intellect and then in the “more than freedom” of the One. Plotinus postulates these divinities as not outside but within each self, saving him from the contradiction of an external foundation for a truly free will. General Topics: Halbig discusses the thesis on the unity of virtues. He dis- tinguishes the thesis of the identity of virtues and the thesis of a reciprocity of virtues and argues that the various virtues form a unity (in terms of reciprocity) since virtues cannot bring about any bad action. Detel examines Plato’s and Aristotle’s conceptions of normativity : Plato and Aristotle (i) entertained hybrid theories of normativity by distinguishing functional, semantic and ethical normativity, (ii) located the ultimate source of normativity in standards of a good life, and thus (iii) took semantic normativity to be a derived form of normativity. Detel argues that hybrid theories of normativity are—from a mo- dern point of view—still promising. Ho ̈ffe defends the Ancient conception of an art of living against Modern objections. Whereas many Modern philosophers think that we have to replace Ancient eudaimonism by the idea of moral obligation (Pflicht), Ho ̈ffe argues that Eudaimonism and autonomy-based ethics can be reconciled and integrated into a comprehensive and promising theory of a good life, if we enrich the idea of autonomy by the central elements of Ancient eudaimonism. Some common themes: The topics in Chinese and Hindu ethics are perhaps more familiar to modern western sensibilities than Homeric and even Socratic. Anagnostopoulos, Brickhouse and Smith, Frede, Liske, Rudebusch, and Russell all consider in contrasting ways the role of moral character, apart from intellect, in ethics. Brickhouse / Smith, Hardy, and Rudebusch discuss the Socratic con- ception of moral knowledge. Brickhouse / Smith and Hardy retain the standard view of the so called Socratic Intellectualism. Shields and Gerson both consider the question whether there is a single genus of goodness, or if the term is a homonym. Bussanich, McPherran, Taylor, and Delcomminette all consider the relation between religion and ethics. Pfister, Piering, Delcomminette, and Liske all consider what sort of freedom is appropriate to human well-being. Halbig, Detel, and Ho ̈ffe propose interpretations of main themes of Ancient ethics. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

Il y a vingt-cinq ans, j’étais un étudiant de doctorat intéressé par la philosophie d’Aristote et à la recherche d’un sujet de thèse. Au cours de mes études supérieures, j’ai eu la chance d’étudier l’Éthique à Nicomaque avec Rémi Brague et Les Politiques avec Judith Swanson. Ces deux érudits m’ont, à leur façon, fait prendre conscience de l’importance d’enquêter sur le public cible des œuvres d’Aristote. Tous deux parlaient en bien du livre Le philosophe et la cité (Les Belles Lettres, (...) 1982) de Richard Bodéüs, qui venait d’être traduit en anglais sous le titre The Political Dimensions of Aristotle’s Ethics (State University of New York Press, 1993). Il se trouva qu’un jour de printemps, ayant été appelé à siéger comme juré, je pris avec moi mon tout nouvel exemplaire du volume de Bodéüs. Heureusement, le jury ne fut pas convoqué, mais on ne me laissa pas partir avant la fin de l’après-midi. Aussi passai-je toute la journée au palais de justice à lire l’ouvrage de Bodéüs et à réfléchir à la relation entre le concept de justice déployé dans l’Éthique à Nicomaque et les analyses des constitutions qu’on trouve dans Les Politiques. Je découvris alors une réflexion savante, riche et profondément historique, portant sur la façon de comprendre les divers traités d’Aristote sur «la philosophie des choses humaines» (EN 10.9.1181b15). C’est ainsi que je fus mis sur la voie du sujet de sur lequel porterait ma thèse : la nature de la justice politique chez Aristote. C’est aussi ainsi que j’en vins à penser en compagnie de l’un des plus éminents spécialistes et traducteurs d’Aristote du siècle dernier. En 2018, la Northeast Political Science Association annonça que sa réunion annuelle allait se tenir à Montréal et invita ses membres à soumettre des contributions dans les deux langues officielles canadiennes. Étant donné que Montréal abrite également l’université dans laquelle Bodéüs avait enseigné, l’Université de Montréal, il m’est immédiatement venu à l’esprit de proposer un panel bilingue pour explorer la philosophie d’Aristote à la lumière de son ouvrage novateur, Le philosophe et la cité, qui fut déterminant pour mon parcours intellectuel. Deux panels furent constitués. Le premier rassemblait les participants anglophones : Jordan Jochim (Cornell University), Kevin Cherry (Richmond University) et moi-même (Quinnipiac University), et fut présidé par Jill Frank (Cornell University). Le second panel rassemblait les participants francophones : Léa Derome (Université McGill), Timothée Gautier (Université Paris 1 — Panthéon-Sorbonne), Louise Rodrigue (Collège universitaire dominicain), et fut présidé par Elsa Bouchard (Université de Montréal). Bodéüs, qui est à présent professeur émérite, accepta généreusement de lire toutes les contributions à l’avance et, combattant un mal de gorge le jour de la conférence, accompagna chacune d’entre elles de commentaires à la fois perspicaces et magnanimes. N’ayant pas pu inclure toutes les présentations de la conférence de novembre 2018, ce numéro de Dialogue comprend les versions révisées de trois contributions : mon “ὁμόνοια: The Hinge of Aristotle’s Ethics and Politics?”, la contribution de Kevin Cherry, “Lawgivers, Virtue, and the Mixed Regime: Reflections on Richard Bodéüs’s The Political Dimensions of Aristotle’s Ethics,” et celle de Louise Rodrigue, «La conception aristotélicienne de la servilité dans l’Éthique et la Politique».
